Why it is worse over there ?
1.The ward can't ask restoration of his right when in Western world jurisdictions the ward can theoretically ask it.
In KZ only the Guardian , the Prosecutor General's Office or a physician can ask it.
2.No automatic review of Guardianship when there are an automatic review of Guardianship in the majority of jurisdictions of the Western World.
3.The appointed Guardian is often a relative but it's not better than ours professional Guardians in the Western World because a Guardian have systematically legally all powers when in Western World jurisdictions we have partial and full Guardianship.
In Western world juridictions it's theoretically possible to adapt the regime to the needs of the ward but it's not possible in Republic of Kazakhstan because there are only one Guardianship regime.

Pourquoi est-ce pire là-bas ?
1.Le protégé ne peut pas demander une mainlevée alors que dans les juridictions des pays occidentaux le protégé peut théoriquement en faire la demande.
Au KZ seul le tuteur , Bureau du procureur général où un médecin généraliste peut faire la demande.
2.Pas de révision automatique de la tutelle quand il y a une révision automatique de la tutelle dans la majorité des juridictions de la civilisation Occidentale.
3.Le tuteur nommé est souvent un proche mais ce n'est pas mieux que nos tuteurs professionnel en Occident parce que le tuteur a légalement systématiquement tout les pouvoirs quand dans les juridictions du monde Occidental nous avons la tutelle partiel et complète.
Dans les juridictions d'Occident il est théoriquement possible d'adapter le régime au besoin du protégé mais ce n'est pas possible en République du Kazakhstan parce que il n'y a qu'un régime unique de tutelle.
PS : J'emploie le mot tutelle dans son sens en droit Français dont l'équivalent est curatelle en droit Québecois tandis que curatelle en droit Français est l'équivalent de tutelle en droit Québecois.
Je le précise pour éviter toutes confusions

ADMIN Petite précision et rectificatif tu dis en France il y a plusieurs régimes de tutelle !!! Non le rapport de Madame Caron deglise est clair : Il y aura bientôt UNE MESURE unique de tutelle en France.
